W-8BEN: telling your US employer or bank you are a non-resident
This form tells a US payer to withhold tax based on your non-resident alien status and any applicable treaty rate, instead of standard US rates.
Who needs to file it
Canadian residents receiving US-source income, such as investment income, royalties, or certain employment income, file this with the payer directly, not with the IRS, to establish non-resident withholding treatment.
What happens if you skip it
Without a filed W-8BEN, US payers often default to a higher backup withholding rate, which you can only recover by filing a US return and claiming a refund, a slower and less certain path.
How the treaty rate applies
The Canada-US tax treaty sets reduced withholding rates for many income types. The W-8BEN is what tells your employer or bank which rate to actually apply.
